Garner Town Council approved a special-use permit (SUPSP2305) for the Yergin Road Apartments after a continued quasi-judicial hearing and deliberation. The hearing reopened the record from a prior meeting and accepted staff and prior sworn testimony into the record but did not call additional witnesses.
Council considered the special-use criteria that govern whether an otherwise-permitted use should receive additional site-specific conditions to mitigate impacts. Those debating the motion split: some council members argued the record showed unmitigated negative impacts and would prefer denial to avoid litigation and preserve taxpayer resources; others said the use is permitted under the UDO and the town could face legal challenge and costs if it denied an application that met statutory tests.
Council member Vance moved for approval and Council member Matthews seconded. After limited discussion, a roll-call vote produced a 3–2 result: yes votes from Council members Vance, Singleton and Matthews; no votes from Council members Dellinger and Stallings. The council specified the permit would include six site-specific conditions recommended by the Technical Review Committee (TRC); staff will finalize the permit record and conditions for the formal permit issuance.
The mayor and staff noted the vote highlights the council’s interest in clarifying the town’s UDO to reflect the council’s policy preferences—particularly to avoid outcomes that do not reflect an intended ‘mixed use’ vision in future rezonings and to reduce the need for litigation.
