At the Dec. 16 meeting the commission approved an after‑the‑fact special permit for land filling and regrading at 223 Michigan Road, following presentation by counsel Amy Zabatakis and engineer Rob Frangione.
Zabatakis said the owner began tree removal and grading without realizing a special permit was required; work stopped when the need for permits became apparent and the applicant prepared a remediation plan. Engineer Rob Frangione provided estimated earthwork volumes: roughly 762 cubic yards removed from the north, approximately 161 cubic yards removed on the south and 624 cubic yards added on the north for a net fill of about 463 cubic yards. Landscape architect Kate Throckmorton described a planting plan emphasizing native species, understory trees and wet‑soil‑tolerant plants as part of the wetland mitigation.
Zabatakis said wetlands and engineering departments reviewed and approved the remediation scheme; the town planner confirmed that the plan did not trigger the town drainage policy and that departments had signed off. Commissioner Chris moved to approve, citing resolution of the issues raised and the completeness of the package; the motion was seconded and the commission voted unanimously to approve the special permit.
