The East Consolidated Zoning Board approved a combined preliminary and final plat for a one‑lot subdivision to be called Johnson Estates and granted the requested minimum infrastructure waiver to allow access onto 135th Street.
Karen Miller of the planning department presented the application and said the roughly 5.6‑acre parcel is zoned RN1. Miller told the board the lot was part of a 2010 unpermitted division that currently prevents building permits; "plat approval would reinstate building rights for this particular piece of property," she said. Staff recommended approval of both the plat and the waiver because the new driveway would relocate an existing approved entrance and provide adequate sight distance without increasing the number of driveways onto the arterial.
Tim Tucker of Phelps Engineering, representing the Johnsons, confirmed coordination with planning staff and that the applicant will work with an adjacent property owner on any private water‑line easement. Miller said water service would be provided by Rural Water District No. 7 and wastewater by private septic.
Roger Spears moved to approve application numbers W25‑524‑PP and W25‑522‑FP for the preliminary and final plat and to approve the minimum infrastructure waiver, citing staff recommendations and stipulations. Donna Goetzmann seconded. The recorded roll call showed unanimous support among voting members present (Jeff Hough, Craig Connell, John DeGran, Roger Spears, Donna Goetzmann, Terry Atwell); the motion passed.
Planning staff said the plat will be considered by the Board of County Commissioners on Jan. 22, 2026 at 9:30 a.m. in the Board Hearing Room, County Administration Building, 111 South Cherry Street, Olathe.
