Project managers presented a comprehensive update to Titles 19 and 20 to align San José’s zoning code with state housing legislation including SB 9, SB 684, AB 1061 and related bills. Staff explained proposed objective design standards and ministerial processes for SB 9 lot splits and modifications to unit configuration, parking and FAR/lot-coverage rules to increase feasibility for small infill projects.
Highlights included proposed adjustments to driveway and access standards for flag/flag-lot configurations, a recommendation to remove garage-facade requirements that limit buildability, and a proposal to allow ministerial subdivision mapping for certain parcelization scenarios. Staff noted outreach to stakeholders and that further updates will be needed to comply fully with AB 1061 and other laws by summer 2026.
Public commenters supported specific technical changes (including clarifying setback rules for heat-pump installations and ADU parcelization). The Commission moved and voted to recommend the amendments to the City Council; the roll-call vote recorded the motion as passed. Staff will prepare Council materials and follow-up memos including a January information memorandum on transit-station areas and a December study-session on development-cost analysis.
