Council adopts AHAC incentive plan, keeps required expedited permitting and defers ADU rulemaking

The City Council on Nov. 19 adopted the Affordable Housing Advisory Committee (AHAC) 2025 Local Housing Incentive Plan and authorized staff to submit it as required for continued SHIP funding. The AHAC report reviewed 11 incentive categories such as expedited permitting, fee waivers, flexible lot configurations and reduced parking requirements.

AHAC representatives summarized the recommendations: maintain mandatory incentives required by statute (expedited permitting and an ongoing review process) and continue the triennial review of public lands; other incentives are recommended either to be maintained, modified or not implemented. The report recommends exploring accessory dwelling units with special regulation but does not require immediate adoption. Amy Yearsley, city planning manager, said the plan’s language directs the city to "revisit the topic of accessory dwelling units" (page 8 of the plan) rather than to adopt final ADU regulations now.

Councilmembers raised concerns about current state legislation on ADUs and the timing of any local regulatory response. Some members endorsed adopting only the required elements now and leaving discretionary incentives for future council consideration; others supported adopting the full set of AHAC recommendations. Council ultimately approved adopting the plan with the required items and left additional items discretionary, as memorialized in Resolution 3 14‑25.

The vote keeps Cape Coral eligible for SHIP funding while preserving council oversight for future local regulatory changes, particularly if state law alters local authority on ADUs.
