The City Commission authorized the city manager on Nov. 20 to negotiate an art-donation agreement for the sculpture known as "Mariposa (Soles)" by Manolo Valdez, offered for donation in the right-of-way near 163rd Street and Collins Avenue. The donor was identified in the resolution as Joseph Milson (transcript also references the name Milton in discussion); the commission directed staff to complete negotiations and return a draft agreement addressing insurance, maintenance and location before final acceptance.
City staff described the administrative process for accepting donations and explained that, although the city has an art fund and related authority, there is no blanket intake procedure for unsolicited free-standing donations tied to private development. Donor counsel Carlos Diaz told the commission, "We're here on behalf of Mr. [Milson/Milton] ... we would like to come up with the donation agreement with the manager and then they'll come back to you for approval." Donor representative Luis Mata said the donor and counsel would provide a draft and be available to answer questions.
Commissioners pressed for specifics: estimated insurance and storm/hurricane protection, maintenance obligations, whether accepting the piece would create ongoing city liability, and whether the city could relocate the work in future years. Staff and counsel responded that insurance would be procured based on value, maintenance clauses would be included in the agreement, and location/relocation contingencies would be negotiated and returned for commission approval in January. Multiple commissioners emphasized a desire for transparency and for a draft agreement to be circulated in advance of the next meeting. The motion directing staff to negotiate the donation was approved on voice vote.
Next steps: staff and legal will prepare a draft donation agreement containing valuation/insurance language, maintenance and relocation provisions, and a licensing or acceptance clause; the commission will consider the final agreement at a future meeting (target: January 2026).
