Council refers McCord Trace 6-foot fence request back to ZBA after resident testimony

The Palos Park Board of Commissioners voted Dec. 8 to refer ZBA case 2025-05 back to the Zoning Board of Appeals after the applicant presented new information about traffic noise and site constraints.
Commissioner Wade described the application: the homeowners association requested variances to increase maximum fence height from 4.5 to 6 feet and to reduce required open space to allow a continuous 6-foot privacy fence along the easterly portion of Lot 38 at McCord Place townhomes (38 McCord Trace). The ZBA had conducted a public hearing (Nov. 12) and recommended denial (3–1, with three members absent).
Roger Jensen, speaking for the applicant, said on Dec. 8 that on-site measurements showed average noise levels near 70 dB and peak levels above 80 dB from motorcycles and heavy trucks. He said the property has only 28 feet of level ground and cannot accommodate berms or tree buffers recommended by IDOT; he asked the council to allow reconsideration so the ZBA can review the new evidence.
Council members agreed the ZBA had not had the benefit of the new data. Commissioner Wade moved to refer the matter back to the ZBA for further consideration; the motion was seconded and approved by unanimous roll call. Council clarified the ZBA will re-review the application and return a recommendation to the council before any final action.
No final variance was granted by the council; the case will return to the council after the ZBA’s follow-up review.
