Davidson County Election Commission certifies District 7 results, adopts challenge procedures and personnel manual

The Davidson County Election Commission certified the December special-election results for U.S. House District 7 and adopted a package of administrative rules and personnel updates at its late-December meeting. Commissioners also called the May 5, 2026 county primary and scheduled security steps for the upcoming Berryhill election.

Administrator Benjure Roberts told the commission that 37% of the office's 235 provisional ballots were accepted after follow-up review and that almost 60% of accepted provisionals came from previously incomplete voter registrations. "That number is higher than we've typically seen," Roberts said, noting causes such as missing signatures or partial Social Security numbers and explaining the office’s process for researching provisional eligibility.

Commissioner Dan Davis moved to certify the results for U.S. House District 7 in Davidson County; the motion was seconded and adopted by voice vote. Chair (unnamed) said the certification reflects the commission's statutory duty regardless of actions taken elsewhere: "We've still got statutory responsibility to certify the results of this election."

On administrative rules, the commission adopted a written petition signature-challenge procedure after a sustained debate about thresholds, who may bring challenges and the role of the state election coordinator. Commissioners agreed to remove language that the commission would adjudicate "in conjunction with the state coordinator of elections or designee" and instead require that the administrator invite the state coordinator or designee to hearing(s) on challenges. Commissioner Byrd said the change was meant to avoid implying the coordinator would participate in deliberations: "I just think it's confusing to add it in here because it all of a sudden starts sounding like something that we're adding." Legal counsel said the coordinator has an advisory role under statute but that the commission makes the final determination about candidate qualifications.

A parallel set of residency-challenge procedures was adopted with the same amendment pattern.

The commission approved a revised Election Commission personnel manual intended to replace a 2003 version. Administrator Roberts said the rewrite clarifies expectations for election-office employees and separates office-specific rules from general Metro HR policies. Commissioners reiterated that staff actions must comply with equal-employment laws and noted that certain machinists continue to be hired by political parties per state statute.

Other actions taken by the commission included calling the May 5, 2026 county primary (motion by Janine Davis) and scheduling the locking of three provisional and absentee bags and bins for the Berryhill election on Jan. 7, 2026 at the conclusion of the commission meeting (motion by Commissioner Burn).

The meeting ended after the commission completed its required review of registration cards for the quarter and set the next meeting for Jan. 7, 2026 at 3:00 p.m.

The commission noted that staff will scan and attach minute backups and that legal counsel and the state coordinator may be involved in challenge hearings as statutorily required.
