Stanislaus supervisors adopt resolutions of necessity for two Kilburn Road bridge replacements

The Stanislaus County Board of Supervisors voted unanimously Oct. 14 to adopt resolutions of necessity to acquire easements by eminent domain for two bridge‑replacement projects on Kilburn Road over Stemmer (Stemba/Stemwick) Creek.
Public Works staff and outside counsel summarized project goals: replace structurally deficient bridges, meet current design and hydraulic clearance standards, improve load capacity and regional circulation, and minimize impacts to private property where possible. Staff said CEQA was approved on Jan. 25, 2022 and Caltrans approved NEPA/CE and route adoption in April 2023 with a subsequent revalidation in August 2023.
For one parcel (APN 049‑012‑001‑001 referenced in staff materials), staff said about 1,600 feet of permanent road easement, roughly 3,000 square feet of permanent maintenance easement and 1,700 square feet of temporary construction easement are required. For the other parcel (APN 049‑011‑009 referenced in staff materials), staff described similar sliver takes and listed square‑foot estimates for permanent and temporary easements.
Board discussion included a supervisor’s recusal for a potential family relationship to a property owner and questions about negotiation history; staff said offers were made (first offer in April 2024 for one parcel) and negotiations have been ongoing. The board approved staff recommendations and authorized County Counsel to initiate eminent‑domain proceedings if necessary.
