Planning board OKs requirement for pre-application conferences and community meetings within one year of application

The Currituck County Planning Board voted Nov. 12 to approve PB 25-19, a staff-initiated amendment to Chapter 2 of the Unified Development Ordinance that requires pre-application conferences and community meetings (when required by the ordinance) to occur within one year preceding application submittal and clarifies who may file development applications.
Jenny, planning staff, said the amendment responds to the county's move toward online permitting and aims to clarify signature and filing authority. Under the proposed language, applications that require a Board of Adjustment or Board of Commissioners decision (for example, variances, rezoning, conditional rezoning, planned developments, or major subdivisions) must be submitted by the owner or contract purchaser or a person authorized to submit, and if there are multiple owners or contract purchasers, all must sign the application or provide a letter consenting to submission. Other development applications may be submitted by an owner, contract purchaser, or an authorized agent, reflecting current practice for many building-permit workflows.
Jenny said staff recommended a one-year window for pre-application conferences and community meetings because the county typically schedules pre-apps within days and a one-year window is "generous" to ensure notified residents remain current. She also noted community meetings require notification to property owners within 500 feet under the ordinance. Jenny said if more than a year has passed since a pre-app or community meeting, applicants would repeat the pre-application conference or community meeting rather than lose the process.
Speaker 3 moved to approve PB 25-19, citing consistency with the Imagine Currituck 2040 vision plan and the UDO; Speaker 5 seconded. Chair (Speaker 1) called the voice vote and the motion passed.
Staff will codify the clarified filing-authority and timing language into the ordinance and update the board on implementation.
