Commission adopts new meeting rules in Resolution 2025-31 after legal clarifications

The Lincoln County Board of Commissioners adopted Resolution No. 2025-31 on Nov. 17, a policy document that establishes rules and regulations for conducting county board meetings.
Commissioners Hughley and Bruns, who spearheaded the draft, walked the board through provisions that define what constitutes a meeting and how advisory committees and task forces are treated under the Open Meetings Act. County legal counsel Tyler clarified that two members of the board are not a meeting by default but noted the Open Meetings Act and case law treat "briefings" and any receipt of information that will be used later as a meeting. "As long as you're not there and you're receiving the information, then that's fine," Tyler said, outlining the statute-based approach commissioners should follow.
Commissioner Bruns moved adoption of Resolution 2025-31 and the motion was seconded and approved by roll call with one recorded 'No' vote. Commissioners thanked staff and county clerk support for work on the policy.
The resolution will be circulated to board members and staff; Tyler offered to provide additional legal briefings if commissioners requested them.
