Lincoln County weed board outlines enforcement steps and limits to county spraying

During the meeting staff described the enforcement sequence the board follows when property owners fail to control noxious weeds. The presenter said enforcement is a legal process requiring inspection, written notice, involvement of the state's attorney and auditor, and adherence to statutory steps before a formal declaration can be issued.

The presenter emphasized the board must act uniformly and cannot target individual properties; inspections are broadened to neighboring acreage to ensure equitable treatment. Staff said the county must have all procedural documentation in order before taking action because the process can proceed as a legal case.

On liability and county-provided services, a speaker who identified themself as a liaison to the highway and sheriff's departments said the county is cautious about using county equipment on private acreage. The liaison indicated the county can provide paid services (charging labor, equipment and chemical costs plus a limited service fee) but tends to refer homeowners to private contractors to avoid displacing private business or taking on undue liability.

The presenter also said three properties with persistent violations will be revisited in spring and that enforcement has been infrequent historically; one participant noted the last known county enforcement action occurred in the 1990s.
