County awaits PSC filing as negotiators draft JDA for Excel Energy 10 Mile Creek project

St. Croix County staff updated the Community Development Committee Dec. 18 on the status of negotiations related to Excel Energy’s 10 Mile Creek transmission project.
Following a county-board resolution, the county engaged Atollis as contract negotiator to assist with a Joint Development Agreement (JDA) and related protections. Staff reported Atollis met with the county’s corporate counsel and Excel and has prepared a redline draft of a JDA. One county priority identified by the board was emergency response planning; Atollis has conferred with county emergency-management staff to review local capabilities. County staff also noted a recent presentation to the county board from Excel’s karst geologist.
Staff provided the Public Service Commission docket identifier for the project materials (4220-CED-190) and said Atollis is waiting for Excel’s PSC application materials before finalizing the JDA negotiation steps. The county’s approach is to refine the redline text, send it to Excel for review, then bring negotiated items back to the committee for further discussion as needed.
What’s next: Staff will monitor the PSC docket filings and return to the committee after additional negotiations or when Atollis identifies unresolved county concerns.
