Lyon County approves Brookview Ranch easement abandonment after residents seek advisory‑board review

Lyon County commissioners on Dec. 18 approved a request to abandon recorded public access and utility easements tied to the Brookview Ranch subdivision on Comstock Road in Dayton, despite several residents asking the board to continue the matter so the Smith Valley advisory board could review it.
Senior Planner Lisa Nash explained the abandonment request and showed the tentative and draft final maps, saying the two recorded easements (25‑ and 50‑foot public access/utility easements and a 30‑foot access/maintenance easement) will be removed and replaced by new easements aligned to the subdivision’s final map. Nash told the board that county utilities have reviewed the proposal and that "these amendments will not negatively impact the surrounding properties and will be replaced with new easements," and that the county has an alternate 100‑foot easement providing access to the infiltration well.
Several residents objected to the timing and asked for the matter to be sent to the citizen advisory board (CAB) so neighbors could review the change. Local resident Russell Herrick said, "We would just like the opportunity to decide that also and go through the process," urging more community review when possible. District Attorney Steve Wright explained the abandonment is effectively required by the previously approved tentative map and that the abandonment hearing is the vehicle to implement what the board had previously approved; he also confirmed the applicant was willing to accept a continuance if the board directed it.
Commissioner Hockaday moved to approve the easement abandonments for the parcels identified in PLZ2025079; Commissioner Hendricks seconded. The board voted 5-0 to approve the abandonments.
What this means: County staff said utility access to the county’s infiltration well will remain via an existing 100‑foot easement and that the record will be updated with the new easements created by the final map. Nash said she will present materials to the CAB in follow-up as requested by the board.
