Jefferson planning commission approves workshop edits to zoning and permit rules, delays Article 6 changes

The City of Jefferson Planning and Zoning Commission on Monday approved proposed workshop revisions to the city's zoning and building-permit ordinance, with one exception: commissioners withheld approval for substantive changes to Article 6 pending further review.

The commission discussed a package of edits intended to clarify definitions, set technical-code references and add a contractor-registration requirement. Speaker 2, who led much of the drafting discussion, said the draft would require contractors who construct, demolish, renovate or repair buildings that need a permit to obtain an annual contractor's license from the city and register with basic business information. "They have to come in and get registered, provide the name of the company," Speaker 2 said during the meeting.

The draft also explicitly adds state-recognized technical standards, which Speaker 1 described as "the International Building Code and appendices as adopted by the International Code Council, the National Electrical Code and the international gas code," language the commission agreed should be forwarded to the city attorney for confirmation of the versions to adopt.

Commissioners removed percentage-based maximum-width and maximum-area rules for building envelopes that they said would be difficult to apply to existing, irregular lots. They kept minimum side and rear setbacks and adjusted accessory-structure height language after a brief discussion led by Speaker 4.

The draft creates an exceptions category allowing property owners to perform their own work without contractor registration when the work does not require inspections. For short-term, front-yard storage related to city yard or garage sales, commissioners proposed a limited temporary-storage allowance "for those days" and up to three additional preparation days unless longer storage is approved by the city.

On governance, the commission approved language limiting appointments to no more than two consecutive terms (a four-year maximum), with reappointment permitted only after at least one full term off. The draft expands eligibility so a member may be a resident or a business owner operating within the city limits or the extraterritorial jurisdiction; commissioners debated geographic breadth and attendance standards during discussion.

Speaker 1 moved to "approve all suggested changes from the workshop with the exception to changes in Article 6," and Speaker 3 seconded. The motion passed unanimously.

Next steps: the commission agreed the ordinance package will be submitted to the city attorney for legal review after the holidays; the group estimated attorney review could take until February, with council consideration potentially in March or April and implementation after council approval.

During final discussion, Speaker 2 raised a separate procedural concern about a stop-work order the commission had issued earlier in a permit matter and said they had not been informed of council action. Commissioners recommended the board chair request an update from City Secretary Melissa or ask a council member to place the item back on the council agenda for an update.

The meeting adjourned following the unanimous vote. The commission will circulate the revised draft and the attorney's comments to members before the next meeting.
