County attorney Mr. Lyle briefed the board on the Code of Virginia procedure when constitutional officers retire: the chief deputy may serve until a special election is called, and the board must petition the circuit court to set a date. Lyle noted the board historically requests the special election be held on the next general election day to avoid the expense and low turnout associated with off-cycle elections. Board members discussed the timing, cost (staff observed off-cycle elections could be costly), and the availability of qualified candidates; one board member said two qualified candidates are ready to step in.
A supervisor moved that staff petition the circuit court to set the special elections for Nov. 3, 2026. The motion carried 6–0.
