Rollerson told commissioners that some of the remediation was necessary to proceed with the larger project and that insurance had authorized certain items; however, the remediation as performed was not entirely covered by a county solicitation. To avoid litigation and because some work was verifiably performed, staff recommended payment of the negotiated amount.
Commissioner Mitchell Wills moved to approve payment of $46,606.28; the motion was seconded and carried by voice vote. Commissioners discussed improving contract clauses and change‑order procedures to prevent similar occurrences, and Rollerson said contracts already include a standard change‑order requirement but staff would review processes to avoid future unilateral work and billing without authorized change orders.
