Council amends alcohol ordinance, sets off‑sale license effective date for Jan. 1, 2027; retailers urge fair fee structure

The Minot City Council unanimously amended a rewrite of the city’s alcohol ordinance on Jan. 5 to set the ordinance’s effective date to Jan. 1, 2027, and approved the draft on first reading.
City Attorney explained that the primary substantive change in the draft is the creation of a separate off‑sale liquor license category in section 5‑12; the attorney recommended an effective date of January 1, 2027 so licensees and city staff would have time to prepare, adopt a fee resolution and carry out outreach before the ordinance takes effect.
During public appearances Jessica Klein, representing Marketplace Foods, said the proposed separate off‑sale license creates inequity for existing license holders that previously paid to obtain full licenses to sell off‑sale liquor. Klein said Marketplace invested over $500,000 across four licenses to comply under the prior framework and urged the council to either retain prior requirements or adopt issuance fees comparable to other North Dakota cities (she cited Grand Forks and Fargo examples from the hearing).
Deborah Hoferth, representing the Magic City Retail Beverage Association, asked the council to prioritize enforcement of license designations and suggested continuing an alcohol committee with stakeholder representation to monitor compliance and special-event licensing.
City Attorney noted that the fee resolution is not before the council at the Jan. 5 meeting and that fee and rate changes are usually presented as part of the budget and fee‑resolution process.
Council amended the draft ordinance to change the effective date to 01/01/2027 and voted to approve the ordinance on first reading; the council did not adopt fee changes at the meeting.
