The Board of Supervisors voted unanimously to grant Conditional Use Permit CU202500007 for an unhosted short-term rental at 4700 Fleming Road, approving the use with changes to the Planning Commission's recommended conditions.
Jamie Sherry, director of planning and zoning, told the board the Planning Commission recommended approval with four amendments: a one-hour reduction in permitted outdoor amplified music (ending at 10 p.m.), a one-year trial approval rather than the standard five years, a cap of 12 reservations per calendar year, and a prohibition on renters operating ATVs and dirt bikes on the property. The Planning Commission had voted 5-0 for that recommendation after neighbors submitted a petition and raised concerns about noise, ATVs and traffic.
Applicant Rogel Vinson spoke to the board and said he maintains the private road that serves the property and asked for a longer approval term. Several supervisors said they were reluctant to place a probationary burden on the property owner where standard conditions exist and remedies for violations are available. On a motion and second, the board amended the Planning Commission's recommendation by restoring the 11 p.m. outdoor-music cutoff, awarding a five-year permit (expires 2031) and removing the 12-reservation cap (returning to the county's standard of no numerical cap). The board kept Planning Commission's prohibition on renters using ATVs/dirt bikes and other standard safety conditions (smoke/CO detectors, emergency access, occupancy limits tied to septic capacity).
The motion passed on a roll-call vote with all supervisors voting yes. Board members and staff noted that code enforcement and existing remedies remain available if complaints arise.
