Council denies pump-detention variance for Highway 6/Pine Lane site after resident opposition

The Manvel City Council declined a requested design-criteria modification and variance that would have allowed a pump-detention system and an exception to the city's 1,000-foot spacing requirement from residences for a proposed commercial site on the northwest corner of Highway 6 and the proposed Pine Lane.
Staff summarized the request: the roughly 2.38-acre tract lies in a FEMA flood zone and within TxDOT and Brazoria Drainage District 4 (BDD4) jurisdiction; because of floodplain constraints the applicant sought a pumped underground detention system rather than a surface gravity pond and a waiver to the city's DCM spacing standard.
The applicant's engineer, Watsel Montpera of MLANZA Engineering, said the pumps are small (about 1 CFS, roughly 449 gpm) and the design would reduce peak discharge from 8 CFS to 1 CFS. He emphasized the pumps are underground and that the system includes safety shutoff valves and a generator for back-up power.
A nearby homeowner, Laurie Simmer Hansel, told council she opposed the proposal. "I am expressing my opposition to the proposed pump detention system that is located within thousand feet of my property," she said, adding concerns about safety, property values and quality of life and urging council to deny approval.
Council discussion centered on two issues: (1) whether the proposal met the city's recently adopted design-criteria standards for pumped detention (including a 50% gravity minimum) and (2) the spacing requirement from residences. Some council members said the city adopted those standards to avoid situations where pump failure could cause catastrophic flooding; others expressed sympathy with the applicant's constrained site but emphasized that alternatives such as off-site regional detention or a reduced site program should be pursued first.
After discussion Councilman Bonner moved to approve the variance; the motion was seconded and failed on a 1-5 vote.
What happens next: staff and the applicant were directed to continue technical coordination (including submitting the latest TxDOT/BDD4-approved plan sets to the city and exploring alternatives). Councilmembers suggested site-plan adjustments, off-site detention conversations and additional modeling/topography to show residential impacts if the applicant returns with revised submittals.
