Staff told commissioners the applicant requested a reduction from the 25-foot front-yard setback to 9.4 feet under R‑2 (two‑family residential) zoning, and noted KIBC 17.155.0.01 requires a 40‑foot setback measured from the centerline of Mission Road for the subject property; for this location that code interpretation equated to a 15‑foot setback from the front property line. The applicant plans to match siding and color to the main structure, place the secondary unit behind a six‑foot fence and perform site work to address structural issues in the primary residence.
No members of the public spoke at the hearing in person or by phone. Commissioner Sean said he spoke informally with neighbors who initially believed the addition would extend beyond the fence; after clarification that the secondary unit would remain within the existing fence line, neighbors were more receptive. Commissioner Chris reminded the commission that because the case is quasi‑judicial, commissioners must disclose ex parte contacts; Sean disclosed his conversations and stated he felt he could remain impartial.
The commission took a roll‑call vote and approved the motion. The record shows five votes in favor and two opposed. The motion directs that the applicant may proceed under the variance described in the staff report and the resolution adopted by the commission.
The commission did not attach additional conditions beyond the findings noted in the staff report. Any building permit, site work or occupancy will remain subject to standard permitting processes, including compliance with applicable building and zoning requirements.
