The policy committee brought Policy 807 (opening exercises, moment of silence and flag displays) to the board for first reading on Jan. 13 with an amendment to include the POW/MIA flag.
Board members expressed support for veterans but also concern about setting precedent by amending flag‑display language. Allison Wilson said she would follow the solicitor’s recommendation and not support changing policy without more legal guidance. Solicitor Sharon Montaigne noted that flag display disputes have appeared in litigation—sometimes involving municipal codes and other types of flags—and advised the board to review any relevant case law before final action.
A board member asked whether state legislation might resolve policy uncertainty; the meeting record referenced Senate Bill 835 as having been referred to the education committee on June 9, 2025, and noted the bill remains pending in committee. The policy will have two readings: first and second readings were scheduled in the committee cycle this month and next, providing time for members to consider legal input before a final vote.
Committee chair said an internal option to display a flag inside a district building (for example, a gym) would carry different risks than permanently adding a display requirement to district policy.
No vote was taken on the policy amendment during the Jan. 13 meeting; staff and the solicitor will provide any relevant case law and the item will return for a scheduled second reading.
