The Montgomery City planning department told the council that a request to rezone 6.8 acres at 6795 Selma Highway from AG-1 to M-1/q was approved by the planning commission, though staff had received an email from the Alabama Department of Conservation and Natural Resources expressing objections and concerns.
"We did receive this email from the Department of Conservation and Natural Resources," a planning staff member said, noting the department reported the adjacent land is used for wildlife and by hunters. Planning staff said the applicant intends to sell the site "to a company that will use it for parking tractor trailers, possibly a small office and storing materials."
A council member raised concerns about the character of development along historic Highway 80, saying the corridor is being parceled into trailer-park–style uses and urging caution given the state's stated wildlife uses of the adjacent acreage. Planning staff said the commission nevertheless approved the rezoning with a condition (described in the record as "with a q").
Council members asked whether the state had explicitly signed off; staff said the applicant did not provide written confirmation of the state's consent before the commission acted. No formal council vote on the rezoning was recorded during the meeting; council members indicated they would discuss the matter further if the state pursued objections.
The item will return to the council as required by the city's process for zoning changes and any public hearing notices associated with that follow-up action.
