Service Director Joe Shaw explained the lot split application would create two parcels where one lot would otherwise contain only an accessory structure. To avoid leaving a parcel with an accessory building but no principal residence, the city negotiated an agreement requiring the owner to obtain a building occupancy or permit for a principal structure within two years; if no occupancy permit is obtained, the city reserves the right to remove the accessory structure via nuisance abatement.
Council introduced and adopted Ordinance 11‑2026 as an emergency measure authorizing the mayor and finance director to enter into the accessory removal agreement with Ryan B. Opiel. Mr. Shaw said the applicant had quickly signed the agreement and that the lot sizes remain substantial after the split. The planning commission will separately review the lot‑split application; council’s action authorizes the city to enter the agreement should the planning commission approve the split.
