The Cape Coral City Council voted unanimously to approve Resolution 368‑25, which vacates approximately 1,559 square feet of unexcavated Dolphin canal right‑of‑way and about 408 square feet of platted public utility and drainage easements adjacent to Lots 9 and 10, Block 14, Unit 1 Part 2, at 909 Dolphin Drive.
Senior Planner Patrick Carlton White told the council staff had reviewed the request against the city’s five vacation criteria and found it met each standard. He said the vacation would enlarge the property and that the city would reserve a six‑foot perimeter public utility easement in connection with the vacation. The hearing examiner had considered the case on Nov. 4 and recommended approval; staff reported no written correspondence opposing the request.
Property owner Richard Blackwell, sworn to testify, told the council the owners seek to expand buildable space, install additional flood protection, and realign easements in a manner consistent with adjacent lots. No other members of the public spoke on the item. The council moved to approve the resolution and recorded an 8‑0 vote in favor.
