Clinton County APC approves three one‑lot minor subdivisions, continues one over pipeline easement

At its January 6 meeting the Clinton County Area Plan Commission approved primary‑plat applications for several one‑lot minor subdivisions and continued one application so the petitioner can resolve an easement issue.
The board approved primary plat CCDash2025-01086 (docket 19-25-SD) by a 6-0 vote (one recusal recorded earlier for unrelated reasons) after staff explained the plat met subdivision control ordinance standards. The commission also approved Davies Prairie Avenue Minor Plat (CCDash2025-01142) and Long Estates Minor Subdivision (CCDash2025-01164) by roll‑call votes of 7-0; staff noted drainage board and health department approvals and said county highway had no objection to proposed drives.
Sophia Estates (CCDash2025-01175) was continued after staff discovered a preexisting pipeline easement (Sunco) crossing the proposed lot. Sunco representatives indicated they allow only perpendicular driveway crossings and requested a site visit and a structural/load analysis before allowing any crossing; Indot (state highway) will not permit access from State Road 39 at the proposed location, so the petitioners may need to redesign the lot, move the house south of the easement, or secure written approval from Sunco. Staff recommended continuing the application to give the petitioner time to address the crossing, and the commission voted 7-0 to continue.
At various hearings staff summarized the standards from the county's Unified Development Ordinance and read relevant state code language describing the plan commission's role to make findings when applications either meet or fail to meet subdivision standards. Several neighbors spoke during public comment on different cases, raising concerns about septic suitability, drainage, and the character of the area; staff noted that the health department, drainage board and surveyor had already signed off on septic suitability and drainage waivers for the approved plats. The commission recorded motions and roll‑call votes on each primary‑plat action, and staff noted that secondary plats and signature changes should be filed with the office once documents are finalized.
Actions and next steps: approved primary plats may proceed to secondary plat preparation and filing; the Sophia Estates application will return after the petitioner works with Sunco and completes any required soil/septic reports or reconfigurations.
