A variance request for a residential dock drew prolonged testimony and was tabled after neighbors and representatives clashed over competing surveys and alleged unpermitted structures.
The applicant, represented by counsel, asked the board for an exception to the city’s 25‑foot riparian setback so a small viewing dock and future small sailboat could be accommodated. Neighbors led by Mr. Sturgis and his counsel contested the application, arguing the applicant’s plans contained inconsistent measurements, lacked signed and sealed surveys, and would place a vessel inside the setback. They also alleged an adjacent property contains unpermitted L‑shaped structures and multiple moorings that exceed allowed numbers, which complicates navigability.
Opponents submitted alternative diagrams and worst‑case vessel scenarios intended to show turning‑radius and beam conflicts; the board’s staff and applicant representatives disputed some of those measurements and noted that the applicant had obtained or pursued Army Corps, DEP and county approvals. Several board members urged a negotiated compromise and recommended limiting any future vessel placed at the new dock by size and by orientation to reduce navigational risk.
After extended public comment, a motion to table the variance passed on a roll-call vote so the parties can pursue direct discussions and so the board can receive clarified measurements and any stipulated restrictions when the item returns. The board did not rule on the merits and emphasized that any future boat placed at the dock would still be subject to code and permit requirements.
