The Palm Beach County Zoning Commission approved a Type 2 variance allowing additional overlap of a recorded FP&L utility easement into a right‑of‑way buffer at a parcel in Palm Beach Park of Commerce.
Joni Brinkman of Urban Design Studio, speaking for the applicant, said an updated survey identified a 10‑foot FP&L easement recorded after prior site plan approvals. She described the request as a housekeeping variance to "cure that situation," noting the site is about "a little over 5 and a half acres" and that a concurrent administrative site‑plan amendment is pending. Brinkman said required plant materials will be installed in unencumbered sections of the right‑of‑way buffer and that the proposed buildings include a repair/maintenance building of about 7,800 square feet and a second building of about 5,800 square feet.
Staff recommended approval; a commissioner moved to adopt a resolution approving item 4a and the commission passed the motion by voice vote. The staff report includes a condition requiring installation of landscape material by a date certain as part of the approval.
The applicant and staff described the easement as having been recorded after the initial site plan and indicated the variance would preserve existing constructed parking while allowing the project to proceed with adjusted planting locations. No public opposition was recorded during the hearing.
The matter was approved by the zoning commission and is now reflected in the record as a granted variance with required conditions.
