A long-pending dispute over glass work at a Dairy Queen was set apart from a larger consolidated matter after Sumner Glass’s counsel told the court his client had not been paid for services performed.
Attorney Greg Cashin said Sumner Glass had been owed roughly $19,500 and ‘‘has never received a dime.’’ He asked the court to bifurcate his client’s claim from the consolidated litigation so the company could have a short, focused hearing with a single witness. Cashin said the work is installed and the business has used it for years while the contractor responsible for paying the glass subcontractor failed to do so.
The judge said severing the claim and allowing related cross-actions against the general contractor to be included in the new hearing appeared the most practical step to resolve the smaller claim and directed counsel to talk with opposing counsel about available dates and to prepare an order to that effect.
The court instructed counsel to include any cross claims against the general contractor so all related issues may be addressed when the severed claim is heard.
