City pauses South Beach Parks concession after vendor objects to termination clause

The Hallandale Beach City Commission on Nov. 19 paused consideration of a proposed concession contract for South Beach Parks after the prospective operator raised last-minute legal concerns. Staff told the commission the vendor's attorney asked for additional review of the termination-for-convenience clause, a change that staff said remains the final unresolved term in negotiations.

City Attorney Marina told the commission the termination clause is currently the "last remaining item of dispute," and staff had offered to extend the notice period to 120 days. Procurement staff said the city solicited roughly 27 proposals for the concession and had been negotiating with the finalist for seven to eight months before the operator's attorney requested a delay late in the day.

Kathy, a staff member managing negotiations, told commissioners that the operator himself had indicated no problem with the 120-day notice but that his attorney had not yet signed off in writing and asked for a two-week postponement that arrived in an email at about 4 p.m. the day of the meeting. "He asked us to delay it at the last minute today," Kathy said.

Several commissioners expressed frustration at the timing. Mayor Cooper said staff had worked hard on the procurement and described the late request as disappointing. Commissioners directed staff to "pause" the item rather than vote that night so staff could retool the agreement and report back with next steps.

What happens next: Staff will revisit contract language, consult with the city attorney and procurement director, and return a revised recommendation to the commission at a later meeting rather than proceed with a vote at the Nov. 19 session.
