The City of Venice Planning Commission on Jan. 6 approved variance petition 2565 VZ, allowing an existing screened enclosure at 114 Corte del Ossolo to remain despite a minor encroachment into the five‑foot setback.
Senior planner Nicole Tremblay told commissioners that records show a permit for the enclosure was issued in 2002 but the original site plan is missing, so staff could not determine whether the encroachment resulted from a plan omission or construction error. Tremblay said the structure “just barely crosses the line there at that five feet,” and that the property backs onto open space.
Agent Andrew Conoboy said the current owners discovered the encroachment during their purchase and sought a variance so a future sale would not be complicated. “It’s extremely minor encroachment,” Conoboy said; he said the issue was identified at closing and the owners are seeking a permanent resolution.
Commission discussion focused on the encroachment’s limited public impact given the adjacent open space and the age of the permitted work. One commissioner described the case as falling under common‑sense circumstances and said “no one was trying to sneak anything through.” With no public speakers on the item, the commission moved and voted to approve the variance (recorded as approved by the commission).
