Owner Carson Malarkey told the board he applied through the city’s e-services but received review comments and resubmit requests and felt caught in conflicting instructions; he said he had been accruing $50-per-day fines while trying to navigate plan-review comments. Board members acknowledged a procedural gap between permitting and code enforcement processes and discussed whether the board could freeze fines while permits were finalized.
After hearing from a plan reviewer, Thomas Story, who said the outstanding items were plan-review corrections that the applicant must address, board members moved to suspend fines until the next hearing and reset the matter so staff could coordinate with development services to clarify outstanding steps. The motion to suspend fines passed by voice vote; the board left the outstanding accrued fine amount in place pending final resolution and provided guidance for follow-up.
