City Manager (Speaker 4) described the property owner, Louise Miller, and said the title company requested the encroachment agreement so a sale may proceed. The survey disclosed the mobile home extends about 1.9 feet into the right‑of‑way. Speaker 4 said the agreement would allow the existing mobile home to remain "unless it's either moved or replaced," and that any future replacement unit would need to be set back inside the property line.
The manager noted a chain‑link fence also extends into the right‑of‑way; he said the fence must be removed prior to the sale, and staff recommended the agreement not accommodate the fence. Speaker 1 asked for clarification on whether the fence would be removed and Speaker 4 confirmed removal would occur before sale.
Speaker 1 moved to approve consent for 1200 West 4th "as presented," Speaker 2 seconded, and the council approved the consent by voice vote.
