The Maricopa County Planning and Zoning Commission voted unanimously to recommend approval of a request to remove an age-restriction condition (condition G) from the Riverwalk subdivision zoning case Z250035.
Staff told the commission the subdivision, located at the northeast corner of 99th Avenue and Olive Avenue, was originally approved with condition G requiring at least one household member to be 55 or older but is not located inside the Sun City senior-citizen overlay. Staff noted the White Tank/Grand Avenue area plan was updated in 2023 and removed the retirement-community designation for this site; staff recommended the commission forward a recommendation of approval to the Board of Supervisors with modified condition language.
Caroline Campos, speaking for Brook Hollow Apartments and the property owner Donald Berg, urged the commission to retain the age restriction, saying their complex is marketed to 55-and-over tenants and that removing the restriction "will probably hurt our business." Staff and commissioners clarified that the condition as written required just one household member per dwelling to be 55 or older and did not bar children from living in the development; the senior-citizen overlay has different standards that do prohibit younger residents.
Commission discussion focused on housing supply and compatibility with surrounding neighborhoods. A commissioner said the change would increase housing flexibility amid rising prices; others emphasized that removal applies only to this subdivision and would not alter senior overlays elsewhere. After public comment the commission moved, seconded and voted by roll call to recommend approval of Z250035 by a vote of 9 to 0.
The matter will advance to the Board of Supervisors for final action in accordance with the staff report and conditions referenced in the hearing.
