Neighbors and counsel presented materials the commission had previously reviewed: screenshots and web records showing online pages, photographs of signage and deliveries, and a history of prior hearings. Counsel for the complainants asked the board to order Hastings to cease business activities, remove signage and address other site condition issues. The neighbor representative said some online listings had been corrected but that the Facebook page and some signage still pointed to the residential location.
Under oath, respondent Mike Hastings said deliveries occur but estimated that business‑addressed packages average about "2 to 3 a week" and said many deliveries were personal household items. Commissioners questioned whether parcel delivery alone constitutes operating a business at a residence, and several members noted ambiguity in the ordinance regarding business‑addressed packages versus personal mail.
After deliberation a motion that "there is no violation" was made, seconded and carried by roll call; the APC denied the complaint. Commissioners noted complainants retain the right to pursue civil remedies or request further enforcement if facts change.
The decision hinged on fact questions about the frequency and character of deliveries, prior APC guidance, and the language of the local zoning ordinance governing home‑based businesses.
