Board authorizes fast-track delisting of HFO-1336mzzc from Virginias VOC list

The State Air Pollution Control Board authorized DEQ to use the Administrative Process Acts fast-track procedure to consider adding HFO-1336mzzc to Virginias list of substances not considered volatile organic compounds (VOCs).
Julia Wack of DEQ described the substance as designed to provide greater insulation at a lower global-warming potential than alternatives and noted EPA issued a final exemption rule in 2019 for a related HFO substance. DEQ staff said the earlier omission of HFO-1336mzzc from Virginias list was brought to their attention during the state public comment period by the Household and Commercial Products Association (HPCA).
Wack told the board that about 45 Virginia facilities could potentially benefit from the delisting, 19 of which are small businesses, and that no facilities are currently known to be using the product within the Commonwealth. She said the compound has a relatively low atmospheric lifetime and is considered negligibly reactive for purposes of ozone formation.
DEQ recommended authorization to promulgate the proposal using the fast-track process and to set an effective date 15 days after the close of a 30-day public comment period, provided no objections from specified legislative or committee actors are received and no substantive changes are required based on public comment. The board moved, seconded and approved the staff recommendation by voice vote.
The fast-track authorization begins a public-comment period in Virginia; the proposal will then be reviewed again by EPA before any final delisting takes effect.
