Alpharetta council approves two temporary circus permits at Northpointe Mall

The Alpharetta City Council voted unanimously Jan. 12 to approve two separate temporary-use applications to host circuses in the surface parking lot at Northpointe Mall between Macy’s and the AMC theater.
Staff presentation by Director Cook described both applications and recommended approval with conditions. The Cirque Italia proposal (PH-26-01) would stage a tented acrobatic theatrical show March 13–16 with set-up beginning March 10 and a seating capacity of 998; staff noted there would be no pyrotechnics or alcohol sales and recommended two off-duty police officers for public safety. Applicant Charles Herwick described the production and said, “The show is about 2 hours long and there is a 30 minute intermission.” No public comments were submitted on the item. Mayor Pro Tem Tim Merkel moved to approve PH-26-01 and the council voted unanimously.
Council then considered Garden Brothers Circus (PH-26-02), a family-oriented production that includes pony rides, inflatables, and other attractions. Staff said the applicant estimated weekday attendance of 500–800 and up to 1,500 per show on weekends, and recommended conditions including on-site sanitation and restroom facilities and the possible hire of off‑duty police when attendance exceeded thresholds. Kylie Shepherd identified herself as the applicant’s vice president and answered council questions. With no public opposition, the council approved PH-26-02 unanimously.
Both approvals were conditioned as recommended by staff and will require the applicants to adhere to the city’s Unified Development Code and any specific operational requirements listed in the staff reports.
The approvals allow the events to proceed on the dates presented, subject to the listed conditions and any required permits or inspections prior to set-up.
