Kansas BSRB reaffirms policy to publish disciplinary orders after board debate

The Behavioral Sciences Regulatory Board on Jan. 12 considered a request to remove or redact a previously posted disciplinary order from the agency’s public website but voted to maintain its existing policy of publishing disciplinary decisions.
Executive Director David Pye reviewed the board’s 2021 policy, which continues earlier practice of posting disciplinary notices (denials, conditions, revocations, suspensions and public censures) on the BSRB disciplinary web page to inform consumers and protect the public. Pye said his review of other states showed the practice is common and typically persistent on public‑facing boards’ pages.
Board members debated the balance between transparency and rehabilitation: some members said past misconduct—even if decades old and fully remediated—should remain public because consumers can decide whether to engage a provider; others queried whether a time‑limited disclosure or an expungement process would be appropriate. Legal counsel and staff explained that an expungement pathway would likely require statutory change by the legislature.
After discussion, the board indicated support for continuing the current posting policy and asked staff to notify the requester that the policy will remain in place unless changed by statute. No formal change to policy was adopted at the meeting.
