County staff presented a draft land development regulation (LDR) amendment on Jan. 13 to introduce rules for mobile food dispensing vehicles (food trucks) in unincorporated Indian River County.
Brandon (county planning staff) said the proposed regulations were written to conform with state law (Section 509.102, Florida Statutes) and would allow food trucks in select zoning districts while limiting placement to avoid obstructing sidewalks, drive aisles and fire lanes. The draft includes hours of operation, waste‑management expectations, signage limits and restrictions on tents and seating unless the presence is part of a permitted special event.
Commissioners discussed removing fixed hours, limiting tents to small canopies that do not impede access, and whether to include general commercial (CG) sites with minimum acreage to avoid small convenience stores hosting long‑term vending. Commissioner Fletcher defended food trucks as local entrepreneurs and asked for reasonable allowances: "I want you to know that, some of the finest food comes out of food trucks." Commissioners noted that a period without enforcement had not produced the anticipated problems and urged a balanced, pro‑business approach while protecting brick‑and‑mortar equity.
Staff emphasized that the meeting was for discussion only; no legislative action was taken. The planning staff will refine the draft based on today's direction, re‑advertise and return with a public hearing for formal adoption.
