Commission approves conceptual modification for Bluewater Bay PD after access dispute

The Indian River County Board of County Commissioners granted final approval Wednesday to a conceptual plan modification for the Bluewater Bay planned development, allowing the developer to proceed without a previously planned bridge that crossed the Lateral D Canal.

County staff explained the request and timeline for a project that originally received conceptual PD approval in 2005 and has partially constructed infrastructure. Brandon (county staff) told the board the applicant sought "a modification to the approved public benefits" and that a recent lawsuit shifted access rights across the Lateral D Canal to a new landowner who would not permit construction of the bridge that had been part of the public benefits package. The modified plan removes the bridge, establishes an emergency access to County Road 510 and retains other completed public benefits such as right‑of‑way dedications.

Staff and the Planning and Zoning Commission recommended approval; staff noted that final construction still requires preliminary PD approval and staff‑level review of engineering and permitting. Applicant representative Anna Saunders said staff had summarized the project and the applicant had little to add.

After questions about infrastructure, traffic coordination with FDOT and the condition of previously constructed utilities, a motion to approve the conceptual changes carried on the board floor. Commissioners emphasized that approval at the conceptual stage does not eliminate later reviews and that any remaining preliminary or final approvals must conform to the negotiated public benefits and construction standards.

The action allows the applicant to proceed into the next design and permitting stages but does not itself authorize construction beyond prior entitlements and existing approvals.
