The Commerce City Board of Adjustment voted unanimously Jan. 13 to grant a variance allowing a proposed Kwik Trip convenience store and fuel station to increase the maximum front-yard setback from 75 feet to 160 feet for property at 716 Eudora Drive.
Planner Nathan Chavez told the board the 2.31-acre I‑1 site has two frontages (Eudora Drive and Elm Street), and strict enforcement of both 75-foot maximum front-yard setbacks would prevent the applicant’s standard store layout. "Because the site is a larger double frontage lot, there is a situation where the strict enforcement of both maximum front yard setbacks would deprive the property privileges enjoyed by property owners of the same zoning district," Chavez said, citing the site’s width and the Kwik Trip building model.
Kwik Trip project manager Tara Limbach described the company’s employment and community programs and said the proposed store represents the company’s larger generation‑4 model; she said the applicant had worked with staff to place the building to optimize circulation for customers and delivery trucks. Galloway’s civil PM explained delivery circulation and canopy clearance requirements for tanker trucks, and the applicant said the 14 tenant/tenant-equivalent panels and site circulation drove the requested layout.
Board members raised concerns about Elm Street, which several described as unimproved. Staff and the applicant said engineering review and the development-review process will address right-of-way improvements: "Approval of the development plan is very, highly contingent on the development agreement and those Elm Street improvements," staff said. The applicant told the board it expects to enter a development agreement to fund half-street frontage improvements and to coordinate timing with the city’s capital improvement plan.
Board member Frey Waite moved to approve AV25-0013; the motion passed 4–0. The board also reopened a brief procedural discussion to confirm truck circulation and improvement requirements before closing the hearing.
