Conservation commission approves partial and full certificates of compliance for 30 Foster Court

The Gardner Conservation Commission voted to approve a partial certificate of compliance tied to the original land-preparation case DT1600335 and a full certificate of compliance for Lot 2 (30 Foster Court; DP1600362).

At the meeting, a staff member (Speaker 4) told the commission that both cases date to the early 2000s and that many of the original entities that managed the development no longer exist, leaving gaps in documentary records. Speaker 4 said a site visit and comparison with GIS records indicate the built work for 30 Foster Court generally matches the original plans and that a partial certificate for the broader original parcel would allow the town to continue resolving outstanding orders on the remaining lots. For Lot 2 (30 Foster Court) Speaker 4 recommended issuing a complete certificate if the commission found the evidence sufficient.

Commission members moved and voted to approve the partial certificate for DT1600335 and the full certificate for DP1600362. One abstention was recorded during the earlier minutes approval; the motions specific to these certificates passed as recorded during the meeting.

Speaker 4 said staff will notify current property owners on other lots that outstanding orders remain and will pursue an overall compliance order for unresolved parcels. The commission instructed staff to circulate documentation for signature and to follow up on any remaining paperwork needed to close related cases.

No further enforcement conditions or additional restrictions were imposed beyond the partial/complete certificates noted at the meeting. The commission recorded the approvals and asked owners to sign the certificates at a later time.
