Attorney Nancy Olin told the council that six months is the maximum duration recommended by Michigan case law for a moratorium but that the council may choose a shorter period. After debate about implementation capacity, procurement workload and ARPA deadlines, council amended the draft to suspend enforcement from 01/13/2026 through 04/30/2026, with automatic resumption on 05/01/2026 unless the council acts otherwise.
Administration representatives said purchasing and economic‑development staff are already heavily tasked with ARPA‑related procurement and that implementing the new contractor‑responsibility processes would require additional staffing and technical assistance to avoid unintentionally excluding local subcontractors. Council members offered different preferred timelines; several favored a 90‑day pause with the ability to extend if necessary. The amended moratorium passed on an amended motion (recorded 7 ayes, 0 nays).
