Trophy Club commission backs repeal of local alcohol-permit fee to comply with state law

The Town of Trophy Club Planning & Zoning Commission unanimously recommended Jan. 8 that the Town Council adopt an ordinance repealing the town’s local alcohol-permit provisions in order to comply with Texas law.

Planning staff told commissioners that Senate Bill 1008, which went into effect Sept. 1, 2025, limits municipal fees for food-service establishments and makes the town’s permit-and-fee section inconsistent with state law. "In a nutshell, it basically limited municipalities ... to double fee, food establishments," the staff member said, and staff recommended striking section 14o2.252 from the town’s zoning ordinance.

The staff report said notice for the public hearing was distributed as required and that no letters in support or opposition were received. The town attorney reviewed the ordinance for form and legality, and staff recommended approval to the council. A presiding commissioner noted the town would forgo roughly $4,200 a year in revenue from the eliminated permit fee; staff said other revenue sources would cover the shortfall.

Commissioners moved and seconded a recommendation for approval; the motion carried unanimously. The commission’s action is a recommendation to the Town Council, which remains the body that will adopt or reject the ordinance at a later meeting.

The commission closed the public hearing at 6:03 p.m. No public commenters spoke on the item during the hearing.
