Judge awards landlord $41,358.42 and issues writ of possession in eviction case

In Valor Homes 100 LLC v. Shoshana Moore and Rodney Brown, the court entered judgment on Jan. 14 for $41,358.42 and granted a writ of possession to allow the landlord to regain the property if tenants do not vacate within seven days.

Plaintiff's counsel said the defendants fell behind on rent and detailed the lease history and outstanding balance. Defendants acknowledged some payments were made early and disputed the total but did not present sufficient documentary evidence to defeat the claim. Plaintiff's counsel asked only for judgment in the stated amount and authorization for writ of possession under OCGA § 44‑7‑55; the court granted that relief.

Judge Hayward explained Georgia law requires rent to be paid while in possession and said the record did not provide a lawful offset. She gave the defendants seven days to remove belongings and turn over keys so the landlord may re‑enter the property.

The court also directed plaintiff's counsel to prepare and submit the order to the clerk for entry.
