Lake County approves resolution streamlining real property conveyance; adds affordable-housing and donation processes

Lake County commissioners voted Dec. 16 to adopt Resolution 2025-37, which establishes and amends administrative procedures governing acquisition, disposition and conveyance of county real property, and includes new provisions to facilitate transfers for affordable housing and voluntary donations.
Matt Hobbs, the county attorney, told the board the resolution was drafted to support a specific affordable-housing effort (referred to in the packet as the '10-2' housing project) by adding a new section that allows conveyance of county property for affordable-housing purposes. Hobbs also said the resolution adds a provision for voluntary conveyances or donations of property (citing a potential donation near Fish Flats at Tennessee Pass as an example). “This primarily started as a project to deal with the housing…and there’s an entirely new section that deals with conveyance of county property for affordable housing purposes,” Hobbs said.
Board discussion focused on how proceeds from sales or donations should be treated. Some commissioners urged keeping proceeds deposited into the general fund as a default to avoid inconsistent accounting practices; others noted that once in the general fund the board can reallocate proceeds later by supplemental appropriation. The board also agreed to simplify the resolution by removing excessive exhibit language and form notices.
Motion and vote: Unidentified Commissioner (Speaker 4) moved to approve Resolution 2025-37; the motion was seconded and the board voted to approve the resolution. The decision was recorded as an affirmative vote and the resolution will replace conflicting earlier resolutions.
Why it matters: the resolution creates a predictable administrative path for using county property to support affordable housing and sets a clear, repeatable process for accepting donated parcels, while leaving financial disposition flexible for future allocation decisions.
Next steps: staff will implement the new procedures for conveyances and coordinate any necessary subsequent actions (e.g., property transfers, notices or budget reallocations). The board approved the resolution during the meeting and also approved the consent agenda, which included a sustainability PSA with the Cloud City Conservation Center.
