County engineer explains planned right-of-way vacation on Rainwood Road; vote set for Dec. 16

The Douglas County Engineer’s Office presented a public hearing Dec. 9 explaining why the county is proposing to vacate triangular parcels near Rainwood Road and sell them back to a nearby developer.
Todd Fitzer said the county previously purchased land to construct Rainwood Road because building a direct east–west alignment would have required extensive retaining walls or buying private property. The county built the road using an alignment that necessitated triangular grade areas. A developer to the north seeks to use the triangular area for drainage that would enable more developable lots. Fitzer said the county negotiated an agreement based on appraised value and intends to sell the parcels for the original cost paid by taxpayers, which he described as producing no net loss to taxpayers.
Commissioner Morgan asked whether the buyer was the original seller; Fitzer said the buyer is the developer and the county purchased the land from an original owner who no longer has an interest. The board opened the public hearing and set the vacation matter for a formal vote on Dec. 16, 2025.
What’s next: The vacation proposal will return to the commission for a vote at the Dec. 16 meeting; materials will be posted to the county website as noted by staff.
