Montezuma County calls executive session to discuss Ironwood wood‑waste litigation; attorney cites judgments over $1 million

County legal staff briefed the Montezuma County Board of County Commissioners on several pending legal matters and recommended the board move into executive session on litigation involving the Ironwood site.
The county attorney reported that a response from Leaf Properties is due Jan. 9 and that the office is continuing work on septic permitting, public‑nuisance property referrals in coordination with the district attorney's office, and upcoming enforcement filings. Regarding the Ironwood site, the attorney said, "something to the effect of over $1,000,000 in fines have been reduced to judgment" and indicated those judgments are owed to the county and to "CDPH." The attorney told the board recent site cleanup progress has been limited.
Because the matters concern legal strategy and options, the county attorney recommended the board go into executive session for a conference with the attorney under Colorado Revised Statutes section 24‑6‑402(4)(b). The board voted in favor of entering executive session, listing the clerk and recorder, commissioners, the county attorney and the administrator as attendees. The board later reconvened, voted to exit executive session and adjourned.
