Vigo County planning commissioners approved UZO 2 of 2026 to regularize zoning for properties at 3655 and 3663 South 14½ Street after a recent subdivision separated residential parcels from commercial storage areas and removed prior grandfathered status for the storage units.
Staff told commissioners the parcels sit in an area identified for neighborhood enhancement, are surrounded by a mix of zoning, and lack access to public water. County records show storage buildings on the parcels since about 1946. The petitioner recently recorded a subdivision, UStored LLC, approved in November to separate two single-family homes from the commercial storage areas. Because the subdivision triggered a loss of grandfathered nonconforming status for the storage units, the petitioner requested rezoning and three variances: relief from the type C buffer yard (section 17), relief from hard-surface parking requirements (section 14(a)(3)), and a 16-foot reduction from the 20-foot minimum side setback (section 903(f)(2).
Richard Shagling, representing the owner, said the filing is a cleanup prompted by the subdivision and that rezoning will place the storage units in the proper commercial zoning classification; he added the separation also makes it easier for the owner to sell the storage units in the future for tax and practical reasons. "This subdivision triggered a loss of grandfather status on the storage units, which resulted in the variances being filed," Shagling said at the meeting.
Staff said it offered a favorable recommendation on the rezoning contingent on approval of the three variances; those variance requests were scheduled for a Board of Zoning Appeals hearing the following day. A motion to approve the rezoning was made and seconded, commissioners replied "Aye" (two "Aye" responses appear in the transcript), and the motion was approved. Staff reported no remonstrators.
The rezoning and pending variance requests are intended to align the parcels’ zoning with their long-standing use as storage/warehouse operations while separating residential parcels created by the recent subdivision. The Board of Zoning Appeals hearing will determine whether the requested variances are granted.
