The Leavenworth County Planning Commission voted unanimously to recommend approval of an exception to Article 50, Section 40.3.I (lot depth-to-width ratio) for a boundary-line adjustment affecting Tract 1 at the corner of Leavenworth Road and 175th (case DEV-25-134).
Planning staff told the commission the parcel exceeds the county's 1:1 lot depth-to-width ratio because the primary access point is along 175th rather than Leavenworth Road. Staff explained the three criteria required for an exception and said that, based on the staff report, the application meets those criteria.
Applicant Joe Herring, a surveyor for the project, told the commission the parties plan to submit a formal plat in the future and offered to answer technical questions about the request. A commissioner moved to approve the exception "based on finding that all three criteria for exception have been met," the motion was seconded and passed on a roll-call vote of 7-0. The recorded yes votes included Marcus Major, Robert Owens, Steve *****, Doug Tyson, William Gotchaik, Jayden Bailey and Joshua Zinger.
The commission recommended that the Board of County Commissioners consider the case no earlier than Jan. 28, 2026, at 9 a.m. at the Leavenworth County Courthouse. No conditions beyond those in the staff report were added by the commission at the meeting.
The matter will return to the Board for final action; the commission's recommendation is advisory.
